Official Rules

1. CONTEST PERIOD: This contest begins at 11:50 AM, ET on April 12, 2010, and closes at 11:50 pm, ET on
   September 30, 2010, the CONTEST CLOSING DATE.
2. HOW TO ENTER: NO PURCHASE NECESSARY.
   
   FIRST PRIZE-TRIP: Enter online at TobleroneTriangleTrip.ca or Voyageausommettoblerone.ca and follow the on-screen entry instructions to submit your email address and register. Once completed click "Submit" and you will be automatically entered into the contest for a chance to win a trip for you and one guest to your choice of one of three destinations. Entries limited to one per email address.
   
   INSTANT WIN PRIZES: There are two ways to enter for a chance to win Instant Win Prizes: 1) Enter online at TobleroneTriangleTrip.ca or Voyageausommettoblerone.ca by following the on-screen entry instructions to enter a PIN CODE found on specially-marked packages of Toblerone Tiny Chocolate Stand-up bags, 150g and Toblerone Chocolate, 100g and continue to follow the online instructions. Once complete, click "Submit" and you will be automatically entered into the contest. If you receive a winning message, you are a potential instant winner of the prize indicated, subject to verification of eligibility and compliance with the terms of these Official Rules, including the requirement to correctly answer a mathematical skill testing question. Follow the on-screen instructions to claim your prize. If you are not a winner, you may return to the website to play again; however, there is a limit of one entry per day per email and each unique PIN code is valid for one entry only; OR 2) Enter by mail by sending a self addressed stamped envelope to: Toblerone Contest PIN Request, 23 Prince Andrew Place, Toronto, ON M3C 2H2 for receipt by contest closing date. The judges will play the game for you and notify you only if you are a potential winner. Entries limited to once per day per email address, regardless of method of entry.
3. PARTICIPATING PRODUCTS: Toblerone Tiny Chocolate Stand-up bags, 150g and Toblerone Chocolate, 100g.
4. ELIGIBILITY: Contest is open to legal residents of Canada who are the legal age of majority in the province or territory where entrant resides as of the Contest Closing Date. Employees of Kraft Canada Inc., ("Sponsor"), Victorinox Swiss Army Travel Gear, Canadian Geographic Magazine, Air Canada, Spafax and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, (collectively, "Promotion Parties"), and the household members and/or the immediate family of any of the above are not eligible to enter.
5. POTENTIAL WINNER SELECTION:
   
   FIRST PRIZE-TRIP: A random draw will be made by contest judges on October 8, 2010, at 2:00 pm ET at Toronto, Ontario, from all eligible entries received on or before the Contest Closing Date. Before being declared a Winner, the selected Potential Winner must correctly answer a mathematical skill-testing question without assistance or mechanical or electronic aid and will be required to sign a standard declaration and release form confirming compliance with the contest Official Rules and acceptance of the prize as awarded. The selected Potential Winner will be notified by Phone call and mail no later than October 15, 2010. If Potential Winner cannot be contacted by October 15, 2010, at Sponsor's discretion, another Entrant may be selected.
   
   INSTANT WIN PRIZES: If you receive a winning message, you are a selected potential instant winner of the prize indicated. Follow the on-screen instructions to claim your prize. Before being declared a winner, the selected Potential Winner must correctly answer a mathematical skill-testing question without assistance or mechanical or electronic aid and will be required to sign a standard declaration and release form confirming compliance with the contest Official Rules and acceptance of the prize as awarded.
   
   A potential winner will need to download and print the Declaration and Release form. Please complete, sign and return the form, within 10 days to the contest administrator at: TOBLERONE Contest, 23 Prince Andrew Place, Toronto, Ontario M3C 2H2, Fax: 416-444-2776.

6. ODDS:
   
   FIRST PRIZE-TRIP: The odds of being selected depend upon the number of eligible entries received.
   
   INSTANT WIN PRIZES: Specific entry times during the contest have been randomly pre-selected as winning times, with random assignment of prizes to those times. A prize will be revealed to the entrant whose entry is submitted at a pre-selected winning time or, if no entry is submitted at that precise time, to the first entrant after the pre-selected time. Actual odds of winning instant prizes depend on time and date of your entry and the number of actual website visits.
7. PRIZES:
   
   FIRST PRIZE-TRIP: There will be one first prize available to be won. The prize is a trip for one winner and one guest to their choice of three destinations: 1. Swiss Alps (Switzerland); 2. Sydney Opera House (Australia); or 3. Giza Pyramids (Egypt). The Prize includes roundtrip, Economy class air travel to their selected destination, from the international airport in Canada nearest winner's residence. Also included in this prize is spending money. Winner will also receive $1,000 in spending money in Canadian funds. In the case of the Switzerland trip, the prize includes an excursion to the Matterhorn and 7 days/6 nights standard hotel accommodation (one room, double occupancy). In the case of the Australia trip, the prize includes a tour of the Sydney Opera House and 7 days/6 nights standard hotel accommodation (one room, double occupancy). In the case of the Egypt trip, the prize includes a 6 day tour of Cairo, Pyramids of Giza, Saqqara, Luxor and the Valley of the Kings, 3 nights accommodation in hotels and 2 nights on-train accommodation. Trip must be completed by September 30, 2011. Approximate retail value of the first prize is $10,000.
   
   The winner and their travelling companion must travel on the same itinerary. The winner and their travelling companion will be responsible for all other expenses not specified herein, including but not limited to: travel and medical insurance, ground transportation to and from the international airport in Canada, gratuities, meals, telephone calls, in-room charges, applicable taxes (including Airport Improvement Taxes), incidentals, and any and all other expenses not specified in the description of the First Prize. The winner or their travelling companion should have a valid major credit card to present to the hotel upon check- in. The winner and their travelling companion are responsible for ensuring that all travel papers (passports, visa, etc.) are in good order, and are valid prior to, and for the entire duration of the trip.
   
   If the travelling companion is a minor in the province or territory where they reside, the parent/legal guardian must accompany the minor on the trip and must obtain and be prepared to produce any written consent or consents from the minor's other parent or legal guardian required by Kraft to permit the minor to travel.
   
   Travel and accommodation arrangements are at the sole discretion of the Sponsor. Absolutely no changes to travel dates or passenger names are permitted once the booking has been made and the Prize winner has submitted the name of the travelling companion and all related booking information to Sponsor. Actual Prize value will depend upon point of departure, travel dates, and airfare fluctuations. Winner is not entitled to monetary difference between actual prize value and stated approximate prize value, if any. If Prize winner elects to travel with no travelling companion, no additional compensations will be awarded. The first prize is only as detailed above. No substitutions or transfers of prize by the winner permitted. Sponsor reserves the right to substitute prizes of equal or greater value, at its sole discretion.
   
   INSTANT WIN PRIZES: At the start of the contest, there will be 2,493 Instant Prizes available to be won. The number of prizes available to be won will diminish throughout the contest period.
   
   The following is a summary of each instant win prize with the corresponding Approximate Retail Value:

   • Two hundred and fifty (250) 400g Toblerone chocolate bars. The approximate retail value per each 400g bar = $8.99
   • Twenty five (25) 4.5kg Toblerone chocolate bars. The approximate retail value per each 4.5kg bar = $89.99
   Total approximate retail value of instant win prizes is $38,200.
   
   Total approximate retail value of grand prize and instant win prizes is $48,200.
   
   The approximate retail value of each prize is that stated by the supplier of the prize as being in effect thirty (30) days prior to the launching of this contest.
8. DECLARATION AND RELEASE: Potential Winner will be required to execute and return a Declaration and Release within ten (10) days of attempted delivery or prize will be forfeited and may be awarded to an alternate Entrant. The travel companion must execute a Declaration and Release prior to prize award.
   
   The return of any prize/prize notification as undeliverable or noncompliance with the terms of these Official Rules may result in disqualification and at Sponsor's discretion, selection of an alternate Entrant.
9. LIMITATION OF LIABILITY: By entering contest, entrant, accepts and agrees to these Official Rules and the decisions of Sponsor, which shall be final in all matters. By accepting prize, winner agrees to hold Promotion Parties, their affiliates, directors, officers, employees and assigns harmless against any and all claims and liability arising out of use or redemption of prize or participation in the contest. Promotion parties, and their respective parents, subsidiaries, affiliated companies, retailers and advertising and promotion agencies and all of their respective directors, officers, employees and assigns (collectively, "Released Parties") are not responsible for printing, distribution, seeding or production errors. Liability for any irregular or defective contest code is limited to replacement with another, while supplies last. Any contest code or participating product that is tampered with, illegible, mutilated, reproduced, contains or reflects printing or other errors, is obtained where prohibited or is not obtained legitimately, will be null and void. Promotion Parties are not responsible for lost or late entries or Declaration and Releases, or for any typographical, or other error in the printing of the offer, administration of the contest, or announcement of the prize, or for technical, hardware, or software malfunctions, computer virus, bugs, tampering, unauthorized intervention, fraud, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this contest, or by any human error which may occur in connection with the serving of contest messages, administration or conduct, in the processing of the entries in this contest, or any other cause beyond the reasonable control of Sponsor that interferes with the proper conduct of the contest as contemplated by these Official Rules. If, in the Sponsor's opinion, there is any suspected or actual evidence of tampering with any portion of the contest, or if technical difficulties or any other factor including accident, printing, administrative, or any error of any kind compromises the integrity, administration, or conduct of the contest, the Sponsor reserves the right, with consent of the Régie des alcools, des courses et des jeux, to modify, cancel, or suspend this contest without prior notice or obligation. If due to a computer programming or other error, more prizes are claimed than intended to be awarded according to Rule 7 for the instant win prize level, stated number of prizes will be awarded in a random drawing from among all valid prize claims received for such prize level. In no event will Sponsor be liable for more than the stated number of instant prizes in Rule 7. Any attempt to deliberately damage any website or to undermine the legitimate operation of this contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
   
   
   Sponsor reserves the right to disqualify a person if he/she enters the contest or tries to do so by any means contrary to these rules or which would be unfair to other entrants or where contest entries are generated by any robotic, automatic, mechanical, programmed or similar entry method. Entry materials that have been tampered with, reproduced, falsified, or altered are void. In the event a dispute arises as to the identity of a potentially winning online entrant, entries made by internet will be declared made by the name on the online entry form.
   
   
   Currency is in Canadian dollars unless otherwise stipulated. Each prize must be accepted "as is" and may not be exchanged for an amount of money, bartered, sold, raffled, substituted, or transferred, and is non-refundable. In the event the stated prizes are unavailable due to reasons beyond the control of Kraft Canada Inc., a prize of equivalent nature and value will be available to be won, or Kraft, in its sole option, may award the winner the equivalent monetary value in lieu of prize. The prize will be delivered only to the confirmed winners.
   
   Refusal to accept a prize releases the Promotion Parties, as well as their respective directors, officers, and employees, of all responsibility and obligations toward the winner of such prize. In no event shall Sponsor be held to award more prizes that what is mentioned in these rules or to award prizes otherwise than in compliance with these rules.
   
   Promotion Parties shall assume no liability whatsoever for any situation in which their inability to act results from an event or situation unforeseeable or beyond their control, including but not limited to force majeure, a strike, lockout, or any other labour dispute at their location or the locations of the businesses whose services are used to hold this event.
10. LANGUAGE DISCREPANCY: In the event of any discrepancy or inconsistency between the English language version and the French language version of the Contest Rules, as applicable, the English version shall prevail, govern and control.
11. CONDITIONS OF ENTRY: Acceptance of a prize constitutes permission for the Sponsor, and their agencies to use winners' names, cities and provinces/territories of residence and likenesses for purposes of advertising and publicity in any and all media now or hereafter known throughout the world in perpetuity, without further compensation, notification, or permission, unless prohibited by law.
    
    All information requested by and supplied by each entrant must be truthful, accurate, and in no way misleading. Sponsor reserves the right to disqualify any entrant from the contest in their discretion, should the entrant at any stage supply untruthful, inaccurate, or misleading details and/or information or should the entrant be ineligible for the contest pursuant to these rules.
12. PROVINCE OF QUEBEC: Any litigation respecting the conduct or organization of the contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize in the contest may be submitted to the Régie only for the purpose of helping the parties reach a fair settlement.
13. PRIVACY: Kraft respects entrants' right to privacy. Entrants' names, addresses, telephone numbers, and e-mail addresses are gathered for the purpose of administering this contest and conducting publicity about this contest. By entering the contest, Entrants consent to Kraft's collection, use, and disclosure of their personal information for these purposes.
